TheAjoApp Terms and Conditions

 

  1.     Acknowledgment

These Terms and Conditions shall apply to your use of the Service provided by TheAjoApp.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service provided by TheAjoApp.

By accessing or using the Service you agree to be bound by these Terms and Conditions. IF YOU DISAGREE WITH THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE PROVIDED BY THEAJOAPP AND YOU MUST IMMEDIATELY DISCONTINUE USE.

You represent that you are over the age of 18. TheAjoApp does not permit those under the age of 18 to use the Service provided.

From time to time, we may change the terms and conditions, therefore we advise that you regularly check for updates. Your use of TheAjoApp will be deemed an acceptance of the terms existing at that time.

 

  1.     Definitions

For the purposes of these Terms and Conditions:

Application means the software program downloaded by you on any electronic device, named TheAjoApp.

Application Store means the digital distribution service operated and developed by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) in which the Application has been downloaded.

Country refers to: United Kingdom

Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to TheAjoApp of 41 Longhorn Avenue, Gloucester, England, United Kingdom, GL1 2AS.

Device means any device that can access the Service such as a computer, a cell phone, or a digital tablet.

Service refers to the Application.

Terms and Conditions (also referred to as “Terms”) mean these Terms and Conditions that form the entire agreement between You and TheAjoApp regarding use of the Service.

 

  1.     Our Service

The information provided when you use the TheAjoApp is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject Us to any registration requirement within such jurisdiction or country. Accordingly, those people who choose to access the Service from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

 

  1.   Intellectual Property Right

We are the owner or the licensee of all intellectual property rights in our Service, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the “Content”), as well as the trademarks, service marks, and logos contained therein (the “Marks”).

Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties in England and around the world.

Our Service may contain links to third-party web sites or services that are not owned or controlled by Us.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that TheAjoApp shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

 

  1.   Group usage and Payment conditions.

Our Service is intended for use by a group of people pursuing mutually agreed objectives within the arrangement worked out by the participants using the TheAjoApp. TheAjoApp is not responsible for the curation, identity, or reliability of the participants in any contribution group.

Processing payment. We aim to make payments as conveniently as possible. Payment is made on TheAjoAapp via Bank transfer or through your Credit or Debit Card, while following the prompts. If we introduce new payment methods or change how payments work, we’ll update our Terms and Conditions to inform you.

Payment Partners: We work with a third-party payment service provider (Stripe) to handle your payments securely. We are here to enable a convenient payment and facilitate the process.

Holding money securely. Whenever you make payment, all monies are safely held until the group’s arrangement is completed. As per agreed group arrangement, the contribution, besides commission, will then be released to the person due for payment.

Safety & security. You should ensure that your payment details are accurate so that payments made on TheAjoApp can be safely and securely processed. Otherwise, your payment might be canceled, or you may be required to prove the payment method is yours or that you authorised a payment, if the payment system raises any suspicion.

 

  1.     Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall We or our directors, employees, or agents be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of money, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Notwithstanding anything to the contrary contained herein, any damages that you might incur, the entire liability of TheAjoApp under any provision of this Terms and your exclusive remedy for all the foregoing shall not be greater than £100 or the total amount paid to us by you during the one-month period immediately preceding the act, omission or occurrence giving rise to such liability through the Service, whichever is lesser.

 

  1.   Term and Termination

These Terms and Conditions shall remain in full force and effect while you use the Service. WITHOUT LIMITING ANY OTHER PROVISION OF THESE LEGAL TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SERVICE TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SERVICES OR DELETE YOUR ACCOUNT AT ANY TIME, WITHOUT WARNING, AT OUR SOLE DISCRETION.

 If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

 

  1.   Governing Law

These terms and conditions shall be governed and construed in accordance with English law.



 

  1.   Disputes Resolution

If a dispute arises concerning the use of the Service, you agree to first attempt to resolve the dispute informally by contacting TheAjoApp. If the dispute cannot be resolved informally, it is agreed to submit the differences to Arbitration in accordance with applicable English Law. If the dispute is such that cannot be resolved through arbitration, it shall be submitted to the Court of England for resolution, which shall have exclusive jurisdiction.

 

  1. Severability and Waiver

If any provision of these Terms is held to be invalid, or otherwise unenforceable, such provisions shall be severed and deleted from these terms and conditions and the remainder of these terms and conditions shall continue to have full force and effect.

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
